Return of illegally leased property
In Kyiv, the execution of a court ruling that returned part of the dormitory premises to the National Transport University has been completed. Previously, a private enterprise used these areas to house a warehouse-shop for building materials, which contradicted the educational purpose of the facility.
Court proceedings
In early 2026, juvenile prosecutors of the Pechersk District Prosecutor's Office of Kyiv filed a lawsuit with the Commercial Court of the capital. They sought to declare the real estate lease agreement, which is on the university's balance sheet, invalid and to oblige the lessee to return the property.
As reported by the Kyiv City Prosecutor's Office, during the review of the case, it was established that the Regional Branch of the State Property Fund of Ukraine for the city of Kyiv concluded a contract with a private company. Under its terms, the non-residential part of the university dormitory located on Boychuk Street was leased out.
Legislation violations
The total area of the premises leased out is 163 square metres, and its appraised value reaches 3.2 million hryvnia. The concluded agreement granted the enterprise the right to independently determine the intended use of the real estate. Taking advantage of this opportunity, the lessee organised a warehouse-shop for building materials on the dormitory grounds.
Meanwhile, current legislation establishes clear restrictions on the use of property of state and municipal educational institutions. In particular, the Law of Ukraine "On Education" prohibits using such real estate for activities not related to its educational purpose. Exceptions are provided only for leasing for the provision of services that the educational institutions themselves cannot ensure but which are necessary for organising the educational process or servicing its participants.
Since the enterprise's activities did not meet these requirements, the prosecutor's office insisted on cancelling the contract and returning the premises to the university.
Court decisions
During the court hearing, the prosecutors' position was supported by both instances — the first and the appellate. The courts concluded that the lease agreement was invalid, as the use of the premises as a warehouse-shop was not related to the provision of educational services.
As a result, the lessee was ordered to return the real estate to the educational institution. Currently, the court ruling has been executed, and the dormitory premises have been returned to the National Transport University.
Recall that previously in Kyiv, a teaching workshop of almost 400 square metres was returned to a college through the courts, which lessees had been using as an automobile service station. The prosecutor's office achieved the declaration of the lease agreement as invalid, and the court ruling has already been executed.
