The German government has officially approved the extension of temporary protection for Ukrainian citizens. The new validity period for the status is set until 4 March 2028. Along with this, additional restrictions have been integrated into national legislation, primarily affecting men of conscription age who plan to move to the Federal Republic of Germany.
Legal framework updates and effective dates
Amendments to the decree regarding the stay of Ukrainians on the country's territory were made by the German Federal Ministry of the Interior. The relevant act was published in the official government gazette, the Bundesgesetzblatt. The new provisions officially came into force on 9 October 2026.
Documentary requirements for men of conscription age
According to the current rules, men of conscription age entering Germany are obliged to provide evidence of one of two circumstances:
- documents certifying the fulfilment of military service and the legality of departure from Ukraine;
- documents confirming that the individual is not subject to mobilisation under current Ukrainian legislation.
In the event that neither of these confirmations can be submitted, the applicant may be denied temporary protection status. It is important to note that these restrictions apply exclusively to newly arrived citizens. For Ukrainian men already residing in Germany who hold the relevant status, no automatic termination of rights is provided for.
Context of the European decision and Berlin's position
Berlin's decision is linked to the pan-European policy. In early August 2026, the Council of the European Union adopted a decision to extend the temporary protection mechanism for Ukrainians until 4 March 2028. At the same time, EU countries were given the option to apply additional requirements to specific categories of newly arrived men of conscription age.
The issue of Ukrainian men of conscription age staying in Europe is actively discussed at the political level. German Foreign Minister Johann Wadephul previously stated the necessity of returning men of mobilisation age to Ukraine. He also emphasised Germany's readiness to assist Ukrainian authorities in identifying such citizens, using data on social benefits, registration, and residence permits.
Who is subject to the new restrictions
The new rules apply to men who crossed the German border after 31 July 2026. Citizens who have already received temporary protection retain the right to use it throughout the entire extended period.
Thus, Germany continues to accept Ukrainians under protection, but the procedure for newly arrived men of conscription age has become more complex: documentary confirmation of the right to leave Ukraine or the absence of military service is now mandatory.
As is known, from 9 October 2026, the conditions for simplified entry for certain categories of Ukrainian citizens changed in Germany. Individuals subject to military obligations must confirm their fulfilment or legal exemption. The validity of the special entry rules has been extended until December 2027.
