Court verdict for demanding an improper benefit

On 22 October 2026, the Southern District Court of the city of Kamianske found Olena Anatoliivna Borovyk, who previously worked as a state bailiff at the Southern Department of the State Bailiff Service (SBS) in Kamianske, guilty. This is stated in the court's verdict.

The woman was found guilty of soliciting and receiving an improper benefit, as provided for by Part 1 of Article 368 of the Criminal Code of Ukraine. As punishment, she was sentenced to a fine of 17,000 hryvnias and deprived of the right to hold positions involving the exercise of functions of a representative of authority for a period of one year.

Circumstances of the case and the defendant's activities

According to the case materials, Olena Borovyk was a native of the city of Verkhivtseve in Kamianske district and had a higher education. She worked as a state bailiff at the Southern Department of the SBS in Kamianske from 8 June 2022. She held the position until approximately 23 July 2026.

The incident occurred after a woman turned to the SBS department, needing to lift a seizure from her mother's apartment. The seizure was discovered by a notary while processing a housing alienation agreement. On 30 June 2026, the applicant visited the department together with her mother.

While reviewing the materials of the enforcement proceedings, the bailiff established the existence of a debtor's debt and provided payment documents for its settlement. She also informed them that the debt had arisen before 2025, and that to lift the seizure, they needed to apply to the court, as the case materials were in the archive.

Demand for money and detention

However, the official later changed her position, according to the court. She stated that the issue could be resolved without going to court, but for this, it was necessary to hand over 11,000 hryvnias. Olena Borovyk warned that from 8 July 2026, she would go on leave, so the money needed to be handed over by that date.

At the end of June 2026, while in office No. 2 at 2 Yaltynska Street, the bailiff repeated her request. Information about the criminal proceedings was entered into the Unified Register of Pre-trial Investigations on 2 July 2026 under number 42026040000000310.

On 7 July 2026, at approximately 13:40, in the same office, the defendant received "imitation" money. After this, law enforcement agencies stopped her activities.

Circumstances that influenced the verdict

Olena Borovyk fully admitted her guilt, confirmed all circumstances set out in the indictment, and expressed sincere repentance. With the consent of the participants in the court proceedings, the court did not examine evidence regarding circumstances that no one disputed. This means that the parties have no right to appeal these circumstances in the appellate procedure.

Among the mitigating circumstances, the court took into account sincere repentance and the voluntary provision of financial aid for the needs of the defence forces of Ukraine. It was also noted that the defendant had no prior convictions, is positively characterised at her place of residence, is unmarried, has no minor children, is not officially employed, and is not registered with a narcologist or psychiatrist.

According to the pre-trial report of the probation centre, the risk of re-offending and danger to society is assessed as medium. Probation concluded that rehabilitation is possible without restriction or deprivation of liberty. The court did not establish any aggravating circumstances, and no preventive measure was chosen.
