A new National Strategy in the field of human rights has been approved in Ukraine, which, among other things, provides for the introduction of administrative liability for discrimination and strengthened protection of citizens, including representatives of the LGBTIQ+ community. This document defines the key vectors of state policy for the coming years.

Key provisions of the document

President Volodymyr Zelensky signed Decree No. 1038/2026 dated 12 October, approving the strategy. This became known on 15 October. The document applies to all persons under the jurisdiction of Ukraine and takes into account the specifics of martial law and the tasks of state reconstruction.

The strategy focuses on equality of rights and protection from discrimination. A special role is played by ensuring access to justice, investigating hate crimes, and providing free legal aid to victims. It also provides for improving the training of law enforcement officers and judges.

Protection of LGBTIQ+ rights

The text of the strategy explicitly states the need to strengthen the protection of LGBTIQ+ individuals from discrimination and intolerance. The document requires improving this community's access to administrative, medical, social, and educational services, as well as legal support.

LGBTIQ+ individuals are identified as one of the groups at high risk of discrimination, hate speech, and other manifestations of intolerance. The strategy provides for clearer enshrinement of sexual orientation and gender identity in legislative protection mechanisms.

In practice, this should ensure predictability in interactions with state institutions. For example, when applying to a medical facility, a person should receive professional assistance and respectful treatment, and when reporting threats, a legal assessment of the circumstances.

Prospects for fines for discrimination

One of the important elements of the strategy is the need to improve protection from discrimination by introducing administrative liability. This means that in the future, an additional mechanism of protection against unequal treatment in the form of fines may appear.

However, specific grounds for liability and the amounts of fines require separate legislative changes, which still need to be developed and adopted.

Implementation and control

The government has been instructed to approve an operational plan for 2027–2029 within six months. This document must define specific measures, executors, deadlines, and performance indicators. Annual public reporting by the Ministry of Justice is also provided for.

For society, the nearest benchmark will be the content of the operational plan. It is from this that it will become clear which procedures will be proposed for change, which decisions require a legislative basis, and how the state will verify the effectiveness of reforms.

Previously, it was reported on the announcement of Kharkiv Pride 2026, where organisers planned to discuss issues of equality and legal protection of LGBTK. Also, in Kyiv, an installation called "Shelter from Intolerance" was installed, aimed at drawing attention to crimes based on discrimination.
