The Dnipropetrovsk District Administrative Court issued a ruling obliging the Territorial Centre for Recruitment and Social Support (TCC) to remove a woman from the military registry. The individual officially changed their gender from male to female and obtained the corresponding documents. In addition, the court ordered the TCC to make the necessary corrections to the information in the "Oberyi" registry.
After completing the gender change procedure and receiving new documents, the citizen applied to the TCC with a request to cease her military registration. However, representatives of the centre refused to satisfy the application. The TCC claimed that current legislation does not provide for gender change as grounds for removal from the registry. The centre also insisted on the necessity of undergoing a military medical commission to make such a decision.
The judicial instance did not support the TCC's arguments. During the hearing, it was established that the plaintiff does not have medical or pharmaceutical education that would obligate women to undergo military registration. It also emerged that she had not planned to register voluntarily.
The court ruling states that the TCC's actions are discriminatory. The judiciary noted an internal contradiction in the situation: one part of the state recognises the person as a woman, while another continues to apply the status of a man to her. In the court's view, such practice violates the principle of legitimate expectations of a citizen.
The final chord of the case was the obligation for the TCC to remove the woman from the military registry and update her personal data in the "Oberyi" registry.
