Antimonopoly Committee begins review of case against two construction firms

The Eastern Interregional Territorial Department of the Antimonopoly Committee of Ukraine (AMCU) has initiated an investigation into two Kharkiv-based economic entities — LLC "NVF "Artos" and LLC "Stroy Inzhiniring Development". The regulator suspects these companies of engaging in collusion during their participation in state procurement procedures. It is important to note that the opening of such a case is an initial stage of the review and does not indicate that guilt or a violation of the law has been proven.

Ownership structure and political connections

The owner of LLC "NVF "Artos" is Kostiantyn Liashenko. The owner of LLC "Stroy Inzhiniring Development" is Petro Zhurba. Particular attention is drawn to the fact that Yevhen Savin was listed among the former founders of the latter company. This individual is known as a deputy from the Party of Regions and a former deputy head of the Kharkiv Regional State Administration.

Evidence of cooperation and court precedents

Court records show that both firms previously had business relations. Specifically, in 2021, a contract was concluded between them, which "Artos" used to confirm its experience when participating in state tenders. The company "Artos" had previously come under media scrutiny due to contracts for the reconstruction of the city of Dergachi in Kharkiv Oblast and accusations of inflating the cost of building materials.

In 2023, the State Audit Service detected violations during the recognition of "Artos" as the winner of a procurement worth 11.12 million UAH. The court of first instance then refused to satisfy the lawsuit seeking to cancel the auditors' conclusion.

Additional violation regarding failure to provide information

In addition to reviewing the case of possible collusion, the Antimonopoly Committee separately initiated proceedings against LLC "Stroy Inzhiniring Development" on the grounds of failing to provide information upon the regulator's request. Currently, AMCU is examining the circumstances of the possible collusion between the two companies during tenders.
