Initiative to change country's leadership

On 31 October, former head of the Polish government Mateusz Morawiecki officially announced his intention to express no confidence in the current cabinet of Donald Tusk. The leader of the "Development Plus" coalition proposed an alternative: to form a temporary technical government to be headed by former Marshal of the Sejm Marek Jurek. According to the initiator's plan, this cabinet would operate until the 2027 parliamentary elections, helping to stabilise the domestic political situation.

Context of the conflict over the court

The trigger for the escalation was a fierce struggle for control over the Constitutional Tribunal. On the evening of 30 October, Judge Anna Korwin-Piotrowska announced the removal from office of the institution's head Bogdan Święczkowski and his deputy Bartłomiej Sochański. Meanwhile, in an official post on the tribunal's social media account on X, it was reported that the website had been "seized" and it was emphasised that the current leadership remains in its positions.

President Karol Nawrocki accused the government of a forcible seizure of the judicial structure. In response, Prime Minister Donald Tusk justified the actions of his subordinates by the necessity of restoring the rule of law. This confrontation was accompanied by protest actions near the tribunal building and an increased police presence.

Procedural requirements for the vote

In accordance with Article 158 of the Constitution of Poland, initiating a constructive vote of no confidence requires a petition submitted by at least 46 deputies of the Sejm. The document must specify a concrete candidate for the position of the new Prime Minister. For the decision to take effect, it requires the support of at least 231 elected representatives.

Voting on such a resolution can take place no earlier than seven days after the submission of the relevant document. If the Sejm supports the vote of no confidence, the president accepts the resignation of the current government and appoints the new head of the cabinet elected by parliament. Thus, Mateusz Morawiecki's political statement alone does not lead to Donald Tusk's resignation — a successful vote in parliament is required for that.
