Declaration registered on day of court ban

A complex legal situation has unfolded around the development at 44 Buchanska Street in Kyiv's Svityshyn district. Despite the Svityshyn District Court of Kyiv ruling on 22 September 2026 to prohibit state registrars and notaries from conducting any registration actions regarding this object, the State Inspectorate of Architecture and Urban Planning (DIAM) registered a declaration of building readiness for operation on the same day.

The declaration was submitted by Akru V. O. It concerned an object named "New construction of an individual residential object (estate type), consequence class CC1, Kyiv city, Svityshyn district, 44 Buchanska Street". According to the technical and economic indicators specified in the document, the building has the following characteristics:

  • total area – 1567 sq. m;
  • residential area – 837.5 sq. m;
  • number of residential rooms – 45.

Thus, a structure with 45 rooms was officially declared as an individual residential building of estate type. Meanwhile, law enforcement agencies have already drawn attention to the possible inconsistency between the building's actual purpose and its documentation. The very fact of registering the declaration on the day the court ban was adopted requires legal clarification: it is necessary to establish the exact time of actions, the moment the restrictions took effect, and the circle of persons to whom they applied.

Notary processed ownership rights after ban

Registration processes did not stop after 22 September. According to available information, on 23 September, private notary of the Kyiv City Notarial District I. M. Hamal registered ownership rights for Akru V. O. for the building at 44 Buchanska Street.

Two days later, on 25 September, the same notary carried out state registration of ownership rights for Akru V. O. for 11 apartments in this building. These actions raise questions about compliance with court restrictions, as the ban had been introduced earlier. Particular attention is required for the change in the status of the premises: an object that initially appeared as an individual building later emerged in the registers as a building with separate apartments.

Local residents suspect possible links between notary I. M. Hamal and the company "450 group". However, there is no documentary confirmation of such relationships in the provided materials, so these claims require separate verification.

Third seizure of land plot and criminal proceedings

On 28 September, the Svityshyn District Court of Kyiv, considering a prosecutor's motion, for the third time placed a seizure on the land plot with cadastral number 8000000000:75:468:0018. This decision has been published in the Unified State Register of Court Decisions.

The preliminary seizure, established on 3 August within the framework of criminal proceedings No. 12025100080002414, was cancelled by the court on 7 September. Following this, on 14 September, the developer submitted a new declaration of object readiness. In the criminal case materials, law enforcement officers are verifying the circumstances of possible document forgery and self-help actions.

Previously, during an inspection of the plot, an unfinished two-storey permanent structure with the start of construction of a third floor, divided into 21 separate premises, was found. Information about the possible sale of approximately 47 apartments was also mentioned. Currently, there is no final court decision on the legality of the construction on the merits.

Twentieth DABK inspection and State Geocadastre plans

On 26 October 2026, representatives of the state architectural and construction control body of the Kyiv City State Administration made the twentieth attempt to inspect the construction at 44 Buchanska Street. The owner of the object, Akru V. O., and her representatives did not appear for the inspection. This creates a paradoxical situation: DIAM has already registered the declaration of readiness, while the local control body cannot conduct an inspection. This casts doubt on the coordination of actions by state bodies and the grounds for registering the declaration without the results of a local-level inspection. At the same time, it should be noted that the registration procedure for CC1 class objects is not identical to the procedure for an unscheduled inspection, so the mere fact of the absence of such an inspection does not yet prove a violation by DIAM.

On 28 October, a further hearing was scheduled to take place at the Svityshyn District Court, but neither the owner nor her lawyers appeared. Further procedural movement of the case requires clarification.

In parallel, the issue is in the focus of the State Service of Ukraine on Geodesy, Cartography and Cadastre. As residents learned from a response from the State Geocadastre, representatives of the department plan to visit the plot to verify its use in accordance with its intended purpose. This inspection may be significant for clarifying the compliance of the actual development with the documented purpose of the land.
