Decision of the Higher Anti-Corruption Court

The Higher Anti-Corruption Court (HAC) ruled to release three defendants in a case linked to the South Ukrainian Nuclear Power Plant from criminal liability. Those released from criminal liability were Vissarion Kim, former acting president of the company "Energoatom" and former director of the South Ukrainian NPP, his son Artem Kim, and former deputy director of the plant Volodymyr Bohatchuk.

Reasons for closing the proceedings

The main argument for this decision was the expiration of the statute of limitations. According to the prosecution's position, the crimes charged against the defendants were completed in 2013. Accordingly, the statute of limitations for prosecution expired in 2023. On these grounds, the HAC closed the criminal proceedings against these three individuals.

It is worth noting that the court had previously released two other defendants in the same case from liability, also citing the expiration of the statute of limitations.

Charges and amount of damages

According to the investigation and prosecution, between 2007 and 2012, Vissarion Kim organised a series of abuses. These actions could have caused material damage to the company "Energoatom" in the amount of 10.52 million hryvnia. In addition, the former director was accused of involvement in another episode involving the probable misappropriation of funds in the amount of 17.42 million hryvnia. The total amount cited in the context of these episodes is 28 million hryvnia.
